Ministry of Economy has initiated the process of public consultation on the draft law for the amendment of some normative acts: Development of remote business in the Republic of Moldova /Contactless Business in Moldova” (https://particip.gov.md/ro/document/stages/*/9912 )
The initiative was prepared on the Economic Council platform and launched by the Deputy Prime Minister for Digitisation and the Minister of Economy at the iCouncil on 22 November this year, with the aim of analysing the online availability of essential public services for entrepreneurs and filling the legislative gaps to ensure the possibility to create and manage a company remotely in the Republic of Moldova.
This draft law will contribute to improving the business environment, reducing red tape and costs for entrepreneurs and will also give our diaspora abroad and foreign investors the opportunity to conduct business in Moldova remotely.
The legislative interventions identified so far cover:
The procedure for granting IDNP to foreign investors (an unavoidable element for remote business registration and management).
Ensuring the application of eKYC and MobiSign for diaspora and foreign investors.
Ensure digital notarization as an option for local entrepreneurs, diaspora and foreign investors.
Establishing the legal regime of the electronic notarial act and the particularities of the electronic notarial activity, the place of the electronic notarial act in the documents issued by the notary, requirements for the electronic act, the way of drafting, signing, registration and archiving.
Mandatory provision of English version of forms and public services for business (forms, incorporation documents, permit documents, interaction with ASP, etc.).
Legalization of remote work, clarification of salary and tax regimes, including VAT, as well as social security contributions (CNAS, CNAM). The proposed amendments make it concrete that foreigners who will be employed in Moldovan companies without becoming tax residents will be exempt from the obligation of mandatory state social security contributions and mandatory health insurance premiums for foreigners.
Possibility of remote employment in these companies of foreign citizens without residence permits in the Republic of Moldova, clarification of the procedural aspects of interaction between foreigners and the competent authorities issuing various permits for foreigners, in order to implement the possibility of submitting documents to its address in electronic format signed by electronic signature issued under the law.
Clarification of the regime of occupational safety, medical certificates and workplace risks for remote employees.
Adoption of best practices applied to Moldova IT visa and other sectors of the economy (valid today only for IT Park residents).
Apply for work permit in Moldova remotely in advance.
