Ministry of Internal Affairs proposes new requirements for foreigners who want to work in Moldova

The Ministry of Internal Affairs proposes amendments to the Law No 200/2010 on the Regime of Foreigners in the Republic of Moldova. According to the authors, the purpose of the draft law is to standardize the documentation requirements for foreigners, exclude potential risks of corruption, facilitate the documentation of citizens of EU states in the context of the Republic of Moldova obtaining the status of candidate country for EU accession.

The project includes, among other things, that foreigners arriving in Moldova to work on the basis of individual employment contracts may only occupy vacant jobs, announced and registered by the applicant beneficiary. The applicant beneficiary has the right to post the foreign worker to another job/enterprise by order, if he/she is the head of the enterprise.

Another amendment says that changing the way of proving the foreigner’s living space in the RM. The intention is to move from notarial authentication of the declaration on the provision of accommodation to the presentation of the document proving the right of ownership or use of the accommodation, including the tenancy agreement.

The changes proposed by the Ministry of Internal Affairswere discussed at the Economic Council with the participation of representatives of the business association sector and representatives of the MAI, the Ministry of Economy and the BMA. Representatives of the business community welcomed the fact that the new changes are in consultation with them but said they bring too many restrictions that discourage investment in Moldova already affected by the war in Ukraine.

Representatives of the Ministry of Internal Affairsr motivated the need to revise the Law No. 200/2010 on the regime of foreigners in the Republic of Moldova for reasons of national security, and announced that the proposed amendments are only the first step in reforming this area and adjusting the regulatory framework in this regard.

The topic of foreigners’ access to the labour market in Moldova has been on the Economic Council’s agenda for a long time, since 2017. Following the discussions The chairman of the working group,Rеduсеrеa oсupation informalе and fеnomеnе of ,,wages in pliс”, Vladislav Caminschi, executive director of the National Confederation of Employers of Moldova noted that the participants in the discussions will continue the dialogue on this topic on the platform of the Economic Council, with the aim of creating a regulatory framework in the field that will stimulate the attraction of labor force, especially from the diaspora, while respecting the requirements of national security.
