State control system over entrepreneurial activity to be reformed 

The first meeting of the working groups on the reform of the system of state control over entrepreneurial activity was held on the platform of the Economic Council to the Prime Minister of the Republic of Moldova. The reform takes place in the context of the Government’s Order of 25 July 2023. In order to carry out the reforms, 8 working groups have been created in the following areas: 1. technical supervision, construction; 2. market supervision and consumer protection; 3. tax, customs; 4. environmental protection; 5. public health; 6. labour protection and safety; 7. agriculture and food; 8. transport (road, naval, aviation).

The first meeting took place in Group No. 1, where proposals for improving state control in the areas of technical supervision and construction were discussed.

Thus, the meeting discussed the problems faced by the business community in these areas and proposed solutions to overcome them based largely on the practices and principles promoted by the Organisation for Economic Co-operation and Development.

According to the data presented during the meeting, the legislation in the field of technical supervision, construction and fire-fighting controls contains some discrepancies, duplications and unjustified provisions. 
 
The participants of the meeting mentioned the need to revise Law 131 of 2012 on state control of entrepreneurial activity. Among other things, it is proposed to introduce in the national legislation specific provisions that do not allow the duplication of control functions, a phenomenon that has been observed today.

It is also proposed to revise the Government decision on quality control in construction on the use of public investment in construction. This is because a number of complaints have been received from economic agents, as this control process is not carried out in a comprehensive manner and deviates from the basic principles of state control regulation. Moreover, economic agents claim that these controls are carried out with exaggerations and disproportionate interventions by the control body.  

The working groups are attended by the State Chancellery, the ministries responsible for policies in the technical areas addressed, the competent control bodies, as well as representatives of the business community and practitioners in the areas discussed.
 
The Secretariat of the Economic Council to the Prime Minister is to provide the necessary assistance in the organisation and functioning of the thematic working groups, monitor their work and present the results of the working groups’ work to the Prime Minister on a quarterly basis.
