Competition law framework to be amended and brought in line with European standards

The authorities will revise the Competition Law in the context of its harmonisation with EU legislation and to strengthen the institutional capacity of the Competition Council in line with European competition rules. The discussions were launched at the proposal of the Ministry of Economic Development and Digitisation, and at the beginning of the discussions, Prime Minister Dorin Recean expressed his support for the initiative of the relevant authorities of the Republic of Moldova.

“The Government’s objective is to create conditions for fair and real competition in the markets of the Republic of Moldova, which will provide the business environment with adequate development potential. The business community can make a decisive contribution to the economic development of the country. At the same time, the challenges in this area will be closely monitored by a more effective Competition Council, which will help the Government to adjust proposals for improving the regulatory framework to achieve these objectives,” the Prime Minister stressed.

The main articles to be revised in the Competition Law concern more effective methods of detecting cartels – one of the most serious infringements causing major distortions in the markets, methods of establishing market shares defining the existence of dominant positions in different markets of certain companies, mechanisms for detecting and sanctioning these types of infringements, as well as new procedural regulations leading to better enforcement of competition law.

For his part, Deputy Prime Minister Dumitru Alaiba said that amending this legislation is a step forward in the process of integrating our country into the EU. At the same time, the amendments will be consulted including with business people and subsequently promoted at an accelerated pace by the Executive.
