
ECONOMIC COUNCIL TO THE PRIME MINISTER OF THE RM
October 10, 2019 – The business community proposes to regulate work through a temporary work agent – work performed by a temporary employee who has concluded an individual contract with a temporary work agent and who is available to the user to work temporarily under his supervision and management.
Eugeniu Covrig, representative of the National Trade Union Confederation, present at the debates organized within the platform of the Economic Council, said that CNSM does not support this form of employment conceptually, because in the national legislation there are several modalities of employment for certain periods.
The representatives of the business community mentioned in reply that companies providing such services are already active in the country. They hire people based on individual employment contracts, and then make them available to companies that are looking for workforce. The problem is that these new employee-employer relationships are not regulated in the RM and leave room for abuse. For these reasons, the business community urges the state to be in step with the development and needs of the labor market and proposes the transposition into national legislation of Directive 104 of the European Parliament and of the Council of 19 November 2008 on temporary employment.
This model of employment existed until the creation of the Directive in 2008, say the representatives of the business community. The European Parliament and the Council of the EU reacted then, seeing that this model is practiced in several member countries and they have created a Directive to standardize the rules in this area.
Under the conditions of the Republic of Moldova, this form of employment comes out of the shadows of informal employment, affirms the experts present at the debates. Among the states that have resorted to this method are Romania and the Russian Federation.
Also, the scientific community recommended amendments to law no. 200 of 16.07.2010 on the regime of foreigners in the Republic of Moldova, through which to regulate and work through temporary work agent and for foreign employees.
The representatives of the Ministry of Labor Health and Social Protection present at the event mentioned that the ministry conceptually supports the draft law elaborated by the associative sector. However, it must be thoroughly examined in conjunction with all stakeholders, so that in the end all rights and obligations between the employee and the employer are regulated.
Vladislav Caminschi, chairman of the Working Group on Reducing Informal Employment and Envelope Salaries, of the Economic Council, who led the meeting, called on all participants in the debates to come forward with proposals to the draft law and to submit them to the Secretariat of the Economic Council. These will be discussed later in technical meetings.
